MGD Collectibles – Terms of Service

OVERVIEW This website is operated by MGD Collectibles. Throughout the site, the terms “we”, “us” and “our” refer to MGD Collectibles. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

SECTION 1 – PRODUCT AUTHENTICITY & CONDITION All products sold by MGD Collectibles are guaranteed to be 100% authentic and factory-sealed unless otherwise stated in the product description.

  • Sealed Product: We are not responsible for the contents of a factory-sealed box (e.g., specific "pulls," card centering, or manufacturer defects).

  • Packaging Condition: We prioritize collector-grade packaging; however, minor cosmetic "shelf wear" on the outer shrink-wrap or cardboard box may occur and does not constitute a "damaged" product.

SECTION 2 – PRICING & MARKET VOLATILITY The Trading Card Game (TCG) market is highly volatile.

  • Prices for our products are subject to change without notice.

  • We do not offer price-matching or "price protection." If the market price of an item drops after your purchase, we cannot offer a refund for the difference.

  • We reserve the right to cancel any order resulting from a pricing error.

SECTION 3 – PRE-ORDER POLICY Pre-ordering an item secures your place in our allocation.

  • Release Dates: Release dates are provided by the manufacturers (The Pokémon Company, Bandai, etc.) and are subject to change.

  • Allocations: In the rare event of a manufacturer "short print" or allocation cut, we will fulfill orders in the order they were received. If we cannot fulfill your order, a full refund will be issued.

  • Cancellations: Pre-orders are subject to a 10% cancellation fee to cover non-refundable transaction processing fees.

SECTION 4 – SHIPPING, DUTIES & CUSTOMS By purchasing from MGD Collectibles, you acknowledge the following shipping terms:

  • Accuracy: You are responsible for providing a correct shipping address. MGD Collectibles is not liable for items delivered to an incorrectly provided address.

  • Cross-Border (US) Shipping: For customers in the United States, all import duties, taxes, and customs clearance fees are the sole responsibility of the buyer. * Refusal: If a shipment is refused by the customer due to customs fees, the customer will be responsible for the original shipping cost and any return shipping fees incurred.

SECTION 5 – LIMITATION OF LIABILITY MGD Collectibles shall not be liable for any lost, stolen, or damaged packages once they have been marked as "Delivered" by the carrier. We highly recommend using tracked shipping services and contacting us immediately if you wish to purchase additional shipping insurance for high-value orders.

SECTION 6 – PROHIBITED USES We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We reserve the right to limit quantities of any products that we offer to prevent "botting" or unfair market manipulation, ensuring our products reach genuine collectors.

SECTION 7 – GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
